Manufacturer’s Declaration for the Hardware of the OneShot and HottScan Scanners
1. General Information
1.1 This manufacturer’s declaration / warranty policy applies exclusively to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) and not to consumers within the meaning of Section 13 BGB.
1.2 Where reference is made below to warranty, this refers exclusively to the statutory rights regarding defects, insofar as these are permissibly limited or specified.
1.3 Mandatory statutory provisions as well as claims arising from intent, gross negligence, or injury to life, body, or health remain unaffected.
2. Warranty Declaration for Hardware
2.1 The warranty period for entrepreneurs is 12 months from the transfer of risk, insofar as legally permissible.
2.2 Where Section 377 of the German Commercial Code (HGB) applies, warranty claims require the proper fulfillment of the statutory inspection and notification obligations.
2.3 The warranty applies only to the original end customer (“Entrepreneur”) and cannot be transferred in the event of resale.
2.4 The manufacturer warrants that the HottScan and/or OneShot scanners are free from material and manufacturing defects when used as intended.
2.5 No warranty claim exists in the event of improper use, excessive strain, or disregard of operating and maintenance instructions. This applies in particular in cases of extreme and/or continuous use.
2.6 Within the warranty period, which begins with the proven date of purchase, the manufacturer undertakes to repair the defective scanner or the affected parts of the scanner or replace them with a new scanner. The warranty period shall neither be extended nor altered after shipment of the repaired or replacement device.
2.7 The replaced scanner or replaced parts of the scanner become the property of HottScan GmbH.
2.8 Consumables or wear parts (e.g. fuses, batteries, capacitors, and USB sticks) are excluded from this warranty declaration. Products and/or accessories from third-party suppliers are also excluded from the warranty declaration.
2.9 The warranty declaration becomes void if the scanner is installed or operated with accessories other than the original accessories supplied by HottScan GmbH.
3. Warranty Declaration for the Firmware of the OneShot and HottScan Scanners
3.1 Where firmware is required for the basic functionality of the device, the above provisions shall apply accordingly.
3.2 Application software, cloud-based services, or third-party software are not covered.
4. Claiming Warranty Services
4.1 Warranty claims must be asserted against HottScan GmbH within the warranty period.
4.2 For this purpose, the customer must contact the helpdesk electronically via the HottScan Modeler application. Both a dated proof of purchase and a description of the defect must be provided.
4.3 HottScan GmbH is under no obligation to provide services if it receives devices for which no warranty claim has been approved. In this case, HottScan GmbH is entitled to return these devices to the customer and charge the customer for the incurred shipping costs. The customer must ensure transport-safe packaging. Where HottScan GmbH organizes the transport, liability shall be governed by the statutory provisions.
4.4 The repaired or replaced scanner will be returned to the customer within a reasonable period of time. The shipping costs incurred through the shipping provider selected by HottScan GmbH shall be borne by the customer. HottScan GmbH is not liable for transport damage. HottScan GmbH shall determine the respective place of performance at its own discretion.
5. Exclusivity of the Warranty Declaration
5.1 In the event of a warranty claim, the customer’s entitlement shall derive exclusively from the above-mentioned warranty declaration. Any other conditions, provisions, or warranties, including those relating to merchantability, fitness for a particular purpose, satisfactory quality, compliance with third-party rights, any assurances regarding the use or compatibility of the scanner with specific software applications used by the customer, and assurances that no damage will occur to the customer’s equipment or data or that the scanner can be used “without problems,” are expressly excluded.
5.2 No warranty claims exist in particular for damage caused by improper use, unauthorized repairs, external influences, or ordinary wear and tear. This warranty does not cover physical damage or malfunctions resulting from the use of the device with external devices.
